Terms of Service for MyBudgetNerd

MyBudgetNerd is offered by Athena Analytics LLC, doing business as Athena Data Labs.

Effective date: April 1, 2026

These Terms of Service (“Terms”) govern your access to and use of MyBudgetNerd (the “Service”) across our iOS application and web application. By using the Service, you agree to these Terms.

1. Use of the Service

• You are responsible for the accuracy, legality, and rights associated with any files or data you upload.
• You may use the Service only for lawful personal or internal business budgeting, planning, and analysis purposes.
• You may not interfere with, disrupt, reverse engineer, or attempt unauthorized access to the Service or related systems.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended budgeting and financial analysis purposes.

3. Uploaded Files and Data

Uploaded files and parsed statement data are processed to provide the Service and are not stored on our servers by default. When Session History is enabled, parsed and categorized data, together with locally cached Oracle and Financial Story snapshots, may be stored on your device using the retention window you select. You can disable Session History or clear local data at any time within the app.

4. Learned Categorization Rules

When you manually change a category, the app may offer to remember that preference for future use. In the current shipping app flow, those learned merchant-category preferences are stored on your device only and can be removed at any time through the app.

5. AI and Oracle Features

• AI categorization is user-initiated and uses sanitized transaction descriptions and account type only.
• Oracle analysis is user-initiated and runs from current transaction rows plus retained local Oracle history when enabled.
• Ask Oracle follow-up requests can use sanitized Oracle summary and aggregate monthly signals instead of raw statement rows.
• Financial Story AI can use sanitized aggregate financial signals instead of raw transaction rows.
• Oracle and Financial Story backend processing is request-scoped and is not persisted on backend storage by default.

6. Authentication and Sign in with Apple

• Some Service experiences may require authentication through Sign in with Apple.
• You authorize us to process Apple-issued identity/authentication artifacts needed to create and maintain your secure session.
• You are responsible for maintaining access to your Apple account credentials and device security controls.
• If you revoke Apple authorization or lose access to your Apple account, authenticated Service features may become unavailable until re-authentication succeeds.

7. Disclaimers

• The Service provides informational budgeting outputs only and does not provide financial, legal, tax, accounting, or investment advice.
• You remain responsible for reviewing your own records and decisions.
• The Service is provided “as is” and “as available,” without warranties except where required by law.

8. Limitation of Liability

To the maximum extent permitted by law, Athena Analytics LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service.

9. Suspension and Termination

We may suspend or terminate access if you materially violate these Terms, misuse the Service, or create security or legal risk. You may stop using the Service at any time.

10. Apple-Specific Terms for iOS

• These Terms are between you and Athena Analytics LLC, not Apple.
• Athena Analytics LLC, not Apple, is responsible for the Service and any support for it.
• Apple has no obligation to provide maintenance or support services for the Service.
• To the extent any warranty exists under law, Athena Analytics LLC is solely responsible for it, and Apple has no warranty obligation for the Service.
• Athena Analytics LLC, not Apple, is responsible for addressing product claims, legal claims, and intellectual property claims related to the Service, to the extent required by law.
• You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.

11. Payments and Future Paid Features

We do not currently process payments or offer paid plans. If paid features or subscriptions are introduced later, we will update these Terms and provide all required pricing, renewal, cancellation, restore, and platform-specific disclosures before purchase.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
