Terms of Service for MyBudgetNerd

MyBudgetNerd is offered by Athena Analytics LLC, doing business as Athena Data Labs.

Effective date: August 6, 2026

These Terms of Service (“Terms”) govern your access to and use of MyBudgetNerd (the “Service”) across our iOS application and web application. By using the Service, you agree to these Terms and our Privacy Policy.

The Service has a free tier and a paid subscription tier. Your first 3 statement analyses are free; continuing beyond that requires a MyBudgetNerd Pro subscription, which renews automatically until cancelled. Pricing, renewal, cancellation, and refund terms are set out in Section 12 and in our Billing Policy.

1. Use of the Service

• You are responsible for the accuracy, legality, and rights associated with any files or data you upload.
• You may use the Service only for lawful personal or internal business budgeting, planning, and analysis purposes.
• You may not interfere with, disrupt, reverse engineer, or attempt unauthorized access to the Service or related systems.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended budgeting and financial analysis purposes.

3. Uploaded Files and Data

Uploaded files and parsed statement data are processed to provide the Service and are not stored on our servers by default. When Session History is enabled, parsed and categorized data, together with locally cached Oracle and Financial Story snapshots, may be stored on your device using the retention window you select. You can delete individual saved uploads, disable Session History, or clear local data at any time within the app.

4. Learned Categorization Rules

When you manually change a category, the app may offer to remember that preference for future use. In the current shipping app flow, those learned merchant-category preferences are stored on your device only and can be removed at any time through the app.

5. AI and Oracle Features

• AI categorization is user-initiated and uses sanitized transaction descriptions and account type only.
• Oracle analysis is user-initiated and runs from current transaction rows plus retained local Oracle history when enabled.
• In Advisor mode, the short written Oracle insight (the headline takeaway) may be phrased by AI from sanitized aggregate signals only (such as the 30-day projection, anomaly count, top rising/falling category names, and monthly income/spend estimates). The figures themselves are always computed on your device and are validated before display — AI rephrases wording and never generates the numbers. If AI is unavailable or its wording fails validation, a deterministic on-device sentence is shown instead.
• Ask Oracle follow-up requests can use sanitized Oracle summary and aggregate monthly signals instead of raw statement rows.
• Financial Story AI can use sanitized aggregate financial signals instead of raw transaction rows.
• Oracle and Financial Story backend processing is request-scoped and is not persisted on backend storage by default.

6. Authentication and Sign-In

• Some Service experiences may require authentication. On iOS, authentication is performed through Sign in with Apple. On the web/PWA, you may sign in with Sign in with Apple or Sign in with Google.
• You authorize us to process Apple-issued or Google-issued identity and authentication artifacts needed to create and maintain your secure session.
• You are responsible for maintaining access to your Apple account credentials and device security controls.
• If you revoke Apple authorization or lose access to your Apple account, authenticated Service features may become unavailable until re-authentication succeeds.

7. Disclaimers

• The Service provides informational budgeting outputs only and does not provide financial, legal, tax, accounting, or investment advice.
• You remain responsible for reviewing your own records and decisions.
• THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. ATHENA ANALYTICS LLC DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATHENA ANALYTICS LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF ATHENA ANALYTICS LLC FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO US TO USE THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50.00).

9. Indemnification

You agree to defend, indemnify, and hold harmless Athena Analytics LLC from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to your breach of these Terms, your misuse of the Service, or any data or files you upload.

10. Suspension and Termination

We may suspend or terminate access if you materially violate these Terms, misuse the Service, or create security or legal risk. You may stop using the Service at any time.

11. Apple-Specific Terms for iOS

• These Terms are between you and Athena Analytics LLC, not Apple.
• Athena Analytics LLC, not Apple, is responsible for the Service and any support for it.
• Apple has no obligation to provide maintenance or support services for the Service.
• To the extent any warranty exists under law, Athena Analytics LLC is solely responsible for it, and Apple has no warranty obligation for the Service.
• Athena Analytics LLC, not Apple, is responsible for addressing product claims, legal claims, and intellectual property claims related to the Service, to the extent required by law.
• You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.
• For subscriptions purchased through the App Store, Apple is the merchant of record and bills you through your Apple Account. Cancellation and refunds for those purchases are handled by Apple under App Store policy, as described in Section 12.

12. Payments and Subscriptions

Free tier. Your first 3 statement analyses are free and require no payment details. The allowance is per account and does not reset.

Pro subscription. Analyzing statements beyond the free allowance requires MyBudgetNerd Pro, offered at $4.99 per month or $44.99 per year. Pro includes up to 25 statement uploads per month, an anti-abuse limit rather than an expected usage level.

Automatic renewal. Subscriptions renew automatically at the end of each billing period, and your payment method is charged the then-current price for the next period, until you cancel. You may cancel at any time; cancellation takes effect at the end of the period you have already paid for, and you keep access until then. To avoid the next charge, cancel at least 24 hours before the current period ends.

How to cancel. Web subscriptions can be cancelled in the app under Controls → Manage Subscription, which opens the Stripe billing portal. iOS subscriptions must be cancelled through your Apple Account subscription settings; Apple, not Athena Analytics LLC, controls cancellation for App Store purchases.

Payment processing. Web payments are processed by Stripe. iOS purchases are processed by Apple, which acts as merchant of record for those transactions. We do not receive or store full payment card numbers.

Refunds. App Store purchases are refundable only by Apple under its policies. For web purchases, contact support@mybudgetnerd.com. Nothing in these Terms limits any non-waivable refund, withdrawal, or cooling-off right you have under the consumer law that applies to you.

Price changes. We may change subscription prices. Changes apply only from a renewal onward, never retroactively, and we will notify you in advance with time to cancel before the new price takes effect.

Effect of non-payment. If a renewal payment fails and is not resolved, Pro access ends and the account returns to the free tier. Your stored data is not deleted because a subscription lapses.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. General Provisions

Governing Law. These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Michigan.

Force Majeure. Athena Analytics LLC will not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to internet or telecommunications outages, third-party service disruptions (including cloud infrastructure or AI providers), acts of God, government actions, or other events outside our direct control.

Entire Agreement. These Terms, together with our Privacy Policy and Cookie and Local Storage Policy, constitute the entire agreement between you and Athena Analytics LLC regarding the Service and supersede all prior or contemporaneous agreements.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative of Athena Analytics LLC.
